Anti Terrorism

THE PROPOSED Anti-Terrorism Act is currently under intense scrutiny by members of the Committees on Justice and on Foreign Affairs, respectively chaired by Representatives Simeon Datumanong (2nd District, Maguindanao) and Antonio Cuenco (2nd District, Cebu City).

The two Committees have conducted joint hearings on the proposed law, which is contained in a draft substitute bill to ten bills all proposing to define terrorism and establishing institutional mechanisms to prevent and suppress its commission.

During last week's meeting of the two Committees on the proposed law, Rep. Cuenco informed the body that all the provisions found in the draft substitute bill came from the ten bills. He also clarified that members of both Committees may still introduce amendments to the draft substitute version prepared by a technical working group created for the purpose.

Justice Secretary Raul Gonzalez stressed that the proposed measure is very important because it bolsters the right of the State to defend itself in the face of terrorist threats.

He emphasized that under the Constitution, the security of the State is the prime duty of the government. "The matter of the right of self-defense and the law of nations is recognized in international law," he added.

Gonzalez also informed the body that Article 51 of the United Nations Charter, as well as UN Resolutions 1267, 1269, 1373, 1455, and 1456, articulate the right of member-states to reject terrorism and all forms of violence against the State.

He also mentioned that RP has joined the ASEAN-Pakistan Joint Declaration for Cooperation to Combat International Terrorism, which recognizes terrorism as a transnational crime.

Meanwhile, Rep. Benasing Macarambon Jr. (2nd District, Lanao del Sur) expressed the view that the proposed law only targets Muslim terrorists.
